Terms of Service
Last updated 26 October 2026
In short: FP_IMAGING turns your design images into renders, edits and films using AI models. Your work is yours. We don't train AI on it. Renders are saved in a folder you choose, not on our servers. You pay us for the software, and AI usage is paid either through your plan's credits or, on enterprise editions, directly by your firm to the AI provider. The full terms follow.
1. Who we are
FP_IMAGING is a product of Fictional Pixel (Pty) Ltd, a company registered in South Africa (registration number 2017/241916/07, VAT number 4590283950), with its registered address at 6 Tyrell House, Crowthorne Corner, Garlicke Drive, Ballito, KwaDukuza, KwaZulu-Natal, South Africa ("Fictional Pixel", "we", "us"). These terms apply to everyone who uses FP_IMAGING, on our public website and on any enterprise edition we host for a firm. By creating an account or signing in, you agree to them.
2. Accounts
- Standard accounts are for individuals and studios using the public FP_IMAGING app.
- Enterprise editions are private copies of FP_IMAGING that we host for one firm. The firm's own administrators ("admins") add and remove people, set each person's monthly AI credit and manage the firm's AI provider key. If your account was created by your firm, your firm is our customer, and its agreement with us also applies.
- Each account is for one person. Don't share your sign-in. Keep your password safe and tell us, or your firm's admin, straight away if you think someone else has used your account.
- You must be at least 18 years old, and allowed to enter into these terms on behalf of yourself or your organisation.
3. How FP_IMAGING works
FP_IMAGING sends your input images and instructions to third-party AI models to produce renders, edits, new views, upscales, video clips and audio. We route these requests through Runware, an AI platform that runs models from several providers (for example Google, Black Forest Labs, ByteDance, Kuaishou, MiniMax, OpenAI and others, depending on the engine you choose). Models and their availability may change; we may add, replace or remove engines.
Enterprise editions use the firm's own Runware account and key. AI usage is billed by Runware directly to the firm, at Runware's prices, with no mark-up from us. The firm is responsible for keeping its Runware balance funded and for its agreement with Runware.
4. Plans, credits and payment
- Public plans (Starter, Studio, Pro and credit top-ups) are described on our pricing page. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Subscriptions renew automatically until cancelled, and you can cancel at any time from the link in your Paddle receipt.
- Enterprise editions are billed per seat, in advance, by invoice, on the terms in the firm's agreement. If an invoice is more than 14 days overdue, we may suspend the edition after giving notice; access returns once the account is settled.
- Credits on public plans. New accounts get a one-off allowance of free credits. Each plan adds its credits once a month. On Starter, unused monthly credits end when the next month's arrive. On Studio and Pro, unused monthly credits roll over while your plan is active, up to three months' worth in total; above that cap, the oldest unused credits are not carried over. When a plan ends, its monthly and rolled-over credits end with it. Top-up credits work on any plan, including after a plan ends, for 12 months from purchase. Each job's cost in credits is shown before you start it; failed jobs are not charged.
- Credits measure AI usage inside FP_IMAGING. On enterprise editions, each person's monthly credit is set by the firm's admin; when it's used up, new jobs stop until the admin adds more or the next month begins. Credits have no cash value.
- We may change prices with at least 30 days' notice. Changes apply from your next billing period.
5. Your content and your results
- Yours stays yours. You keep all rights in the images, drawings, models and instructions you upload ("inputs") and, as far as the law allows, in the renders, edits and films FP_IMAGING produces for you ("outputs"). We claim no ownership of either.
- Permission we need. You allow us to process your inputs and outputs only as needed to run FP_IMAGING for you: sending them to the AI model you choose, returning the result, and keeping the records described in our Privacy Policy.
- No training. We do not use your inputs or outputs to train AI models. Runware states that it does not use API data to train models.
- Your responsibility. Only upload material you have the right to use. You are responsible for how you use outputs, including any permission needed from clients, architects or rights holders.
- AI is illustrative. Outputs are visualisations, not technical drawings. They can contain inaccuracies, invented details or changes to your design. Check every output before you present, publish or rely on it. Outputs must not be used as construction, engineering, planning or compliance documents. Where the law or your client requires it, say that an image was made or changed with AI.
6. Acceptable use
You must not use FP_IMAGING to: break the law or anyone's rights; create content that is deceptive, defamatory, hateful, sexual involving minors, or otherwise prohibited by our AI providers' policies; misrepresent a real building, product or place in a way meant to mislead buyers, authorities or the public; attack, overload, probe or copy the service; or get around credit limits, seat limits or security. We may suspend accounts that do.
7. Saving your work
Renders, edits, new views and upscales are saved in a folder you choose on your computer or network, and in your browser. We do not keep copies of them on our servers. Video clips, audio, saved films and exported films are also saved in your folder; a private working copy for each person is kept on our server so films can be assembled. You are responsible for backing up your own folder. If you clear your browser or lose your folder, we cannot recover stills for you.
8. Our access to enterprise editions
We host each enterprise edition and therefore have technical access to it. We access an enterprise edition only to keep it running and secure, to install updates, to investigate a problem the firm has reported, or to restore admin access at the firm's written request. Fictional Pixel holds no account in a firm's edition unless the firm creates one for us. Whenever we restore admin access, a notice is shown to every admin of that firm in People and seats and cannot be removed. We never look at, use or share a firm's content for any other purpose.
9. Availability and changes
We aim to keep FP_IMAGING available at all times, but we don't guarantee it will be uninterrupted. Updates may take the service offline for a few seconds; we schedule them outside normal working hours where we can. AI providers may be slow, change behaviour or be unavailable. We may improve and change features; if we remove something important to a paid plan, we'll tell you in advance.
10. Ending your use
- You can stop using FP_IMAGING and cancel at any time. A firm's admin can remove people from its enterprise edition at any time; that person's private files on our server are deleted when they are removed.
- We may suspend or close an account that breaks these terms, or an enterprise edition whose invoices remain unpaid, after notice where reasonable.
- When an enterprise agreement ends, the firm has 30 days to collect anything it needs; after that we delete the edition, its accounts and its files from our servers. Backup copies are erased automatically within 7 days after that.
11. Our software
FP_IMAGING, its design, code, prompts and methods belong to Fictional Pixel. You may use it while your account is active. You must not copy, resell, reverse-engineer or build a competing product from it.
12. Warranties and liability
- FP_IMAGING is provided "as is". To the extent the law allows, we don't promise it will be error-free or that outputs will be accurate or fit for a particular purpose.
- To the extent the law allows, our total liability to you for any claim related to FP_IMAGING is limited to the fees you paid us in the 12 months before the claim. This limit does not include AI usage paid directly to Runware or another provider.
- We are not liable for indirect or consequential losses, such as lost profits, lost projects or lost data you could have backed up.
- Nothing in these terms limits liability that cannot be limited by law, or your rights under consumer protection law where it applies to you.
13. General
- These terms are governed by the laws of the Republic of South Africa. Where a firm has a signed agreement with us, that agreement takes priority over these terms where they differ.
- We may update these terms. We'll show the date at the top and, for material changes, tell account holders at least 30 days before they apply.
- If part of these terms can't be enforced, the rest still applies.
